Fair Work Australia issued its Annual Wage Review Decision on 1 July 2012, introducing some key changes to employment laws in relation to wage entitlements and eligibility thresholds to make an unfair dismissal claim.
Employees who earn more than the high income threshold and who are not covered by a modern award generally cannot make a claim for unfair dismissal under the Fair Work Act. From 1 July 2012, the Review determined that:
- the high income threshold be increased from $118,100 to $123,300; and
- the compensation limit payable in the event of a successful unfair dismissal claim be increased from $59,050 to $61,650.
Also, from the first full pay period from 1 July 2012:
1. the minimum weekly wages of adult employees covered by modern awards increased by 2.9%;
2. the national minimum wage for adult employees not covered by an award increased from $589.30 per week to $606.40 per week ($15.96 per hour); and
3. the casual loading for adult employees not covered by modern awards increased from 22% to 23%, whilst for those covered by modern awards it remained unchanged.
